Terms of Service

1. Acceptance of Terms

By accessing or using the Coach Joel's Way Youth Fair Play Coaching Platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all users, including coaches, administrators, organizations, and any other authorized users.

Use of the Service is also subject to the Coach Code of Conduct, which is incorporated by reference. For detailed acceptable use guidelines, see our Acceptable Use Policy.

2. Description of Service

Coach Joel's Way Youth Fair Play Coaching Platform is a web-based and mobile-accessible application designed to assist youth baseball and softball coaches with lineup management, player tracking, and team organization using data-informed tools.

The Service may include:

• Lineup creation and management
• Player and roster management
• Game scheduling and statistics tracking
• Scouting and player evaluation tools
• Team and organization management features

The Service provides decision-support tools only and does not guarantee outcomes, playing time, competitive success, or player development results.

3. Eligibility and Authority

You must be at least 18 years old to create an account.

By using the Service, you represent and warrant that:

• You have the legal authority to act on behalf of your team or organization
• You have obtained all required permissions and consents (including parental or guardian consent where applicable) to provide player information, including information related to minors

By creating an account or using the Service through the Coach Joel's Way Fair Play mobile application, you confirm that you are an adult coach, administrator, or authorized organizational representative. The Service is not intended for use by players or minors directly.

4. User Accounts

4.1 Account Creation

You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

4.3 Account Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if required to protect the Service, users, or legal interests.

Upon termination, your access to the Service will cease, and certain data may be deleted in accordance with our Privacy Policy. Violations of our Acceptable Use Policy or Coach Code of Conduct may result in account termination.

5. Acceptable Use

You agree not to:

• Use the Service for unlawful or unauthorized purposes
• Misuse or misrepresent data generated by the Service
• Upload false, misleading, abusive, or inappropriate content
• Attempt to interfere with or compromise the Service's security
• Use the Service to harass, discriminate, or retaliate against players or families

6. Player Data and Coaching Responsibility

The Service provides tools intended to support coaching decisions. Final coaching decisions, including lineups, playing time, and player roles, remain solely your responsibility.

Coach Joel's Way Youth Fair Play Coaching Platform:

• Does not replace human judgment
• Does not guarantee fairness outcomes
• Is not responsible for disputes arising from coaching decisions or team management

You agree that you are solely responsible for how Service data is used and communicated.

The Service provides informational tools only. All coaching decisions, including but not limited to playing time, positions, roster selection, and lineup construction, are made independently by the coach or organization. Coach Joel's Way Youth Fair Play Coaching Platform does not control, enforce, or guarantee any outcomes derived from the use of the Service.

7. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

8. Privacy / Apple Compliance

Use of the Service through Apple devices is subject to Apple's App Store Review Guidelines. Coach Joel's Way Youth Fair Play Coaching Platform is solely responsible for the Service and its content, and Apple has no obligation to provide support or maintenance for the Service.

9. Intellectual Property

9.1 Our Rights

All software, design, trademarks, logos, and platform content are owned by Coach Joel's Way Youth Fair Play Coaching Platform and protected by applicable intellectual property laws.

9.2 Your Content

You retain ownership of content you submit. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and display such content solely for operating and improving the Service.

10. Feedback

If you provide feedback, suggestions, or ideas, you grant us the right to use them without restriction or compensation.

11. Service Availability

We do not guarantee uninterrupted or error-free operation. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF DATA, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COACH JOEL'S WAY FAIR PLAY COACHING PLATFORM SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Coach Joel's Way Youth Fair Play Coaching Platform from any claims arising out of:

• Your use of the Service
• Your content
• Your violation of these Terms
• Your handling of player or minor information

15. Third-Party Services

The Service may integrate or link to third-party services. We are not responsible for third-party content, policies, or practices.

16. No Employment or Agency Relationship

Use of the Service does not create an employment, partnership, agency, or fiduciary relationship.

17. Modifications

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Nevada. Any disputes shall be resolved exclusively in state or federal courts located in Nevada.

19. Severability

If any provision is found unenforceable, the remaining provisions will remain in full force.
